Please read these Terms carefully. By accessing BookSurf (book-surf.com) or using the BookSurf GhostWriter application (app.book-surf.com), you agree to be bound by these Terms with Spillwave LLC (Texas, USA), which operates BookSurf.

Service Description

BookSurf provides tools to help you plan, draft, and publish book content. Drafts are generated by AI providers based on your inputs and selections.

Eligibility; Accounts

You must be at least 13 to use the service. You are responsible for maintaining the confidentiality of your account and for all activities under it.

Subscriptions, Credits, and Billing

Paid features may be billed by subscription or via usage credits. All purchases are final; no refunds. Usage credits do not expire. Prices, features, and credit entitlements may change; changes will not apply retroactively to completed purchases. Taxes may apply based on your location.

Acceptable Use

You agree not to misuse the service, including by: violating laws, infringing intellectual property, generating or distributing unlawful content, attempting to access other users’ data, or interfering with service operation. Prohibited content includes pornography, misogynistic content, and hardcore violence.

Your Content

You retain ownership of your inputs and edits. You grant BookSurf a non‑exclusive license to process your content for the limited purpose of providing the service, including via service providers and AI model providers acting on our behalf. We do not use your content to train our own models, and where available we instruct model providers not to use your data for training.

Generated Output

Subject to provider terms and applicable law, you may use generated drafts and exports for your own purposes. You are responsible for reviewing, editing, and validating output for accuracy and suitability.

Third‑Party Services

We integrate with third‑party processors including OpenAI, Anthropic, Google (AI/Cloud), Perplexity, Stripe (payments), and Google Analytics/Tag Manager. Your use of those services may be subject to their terms.

Intellectual Property

The website, application, and underlying technology are owned by Spillwave LLC (BookSurf) and its licensors. These Terms do not grant you any rights to our trademarks or source code.

Disclaimers

BOOKSURF IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. AI‑GENERATED CONTENT MAY BE INACCURATE OR INCOMPLETE. YOU ARE RESPONSIBLE FOR YOUR USE OF OUTPUT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKSURF AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE.

Indemnification

You agree to indemnify and hold BookSurf harmless from claims arising from your use of the service or violation of these Terms.

Termination

We may suspend or terminate access for any violation of these Terms or risk to the service. You may stop using the service at any time.

Governing Law; Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict of laws. Disputes will be resolved in the state or federal courts located in Travis County, Texas, unless otherwise required by law.

Changes to Terms

We may update these Terms from time to time. Material changes will be posted with an updated effective date. Continued use after changes constitutes acceptance.
